General Terms of Service
Warranty Terms and Conditions for Purchased Pocket Wi-Fi Router Device
1. Unless otherwise specified, the Limited Warranty provided by Brightline Communications Pte Ltd (“Brightline”) is valid for 12 months from the date of delivery (“Warranty Period”) and only in Singapore.
a. The Limited Warranty is valid only for the original purchaser (“Purchaser”) of the Pocket Wi-Fi Router (“Device”) and is not transferable.
b. The Limited Warranty covers defects in material and workmanship encountered under normal use and installation of the Device, subject to these terms and conditions. The defective Device or parts thereof covered under the Limited Warranty will be repaired or replaced (with comparable and/or refurbished Device or parts) as determined by Brightline in its sole discretion. Any Device or part thereof replaced shall become the property of Brightline.
c. Any delivery and other incidental charges and charges for services beyond the scope of this Limited Warranty shall be borne by the Purchaser.
d. The Limited Warranty does not cover:
i. Loss or damage to Device arising from or in connection with (i) abuse, tampering modification and/or disassembling other than by Brightline authorised personnel; (ii) negligent use and/or misuse (including improper storage, exposure to moisture, excessive temperature, sand, dust, dirt, other pollution or other environmental conditions and failure to follow recommended precautions and operating instructions); (iii) fire, flood, lightning, strike or other acts of God; and (iv) accidental damage.
ii. Loss or damage to Device arising from or in connection with the malfunction of, connection to and/or use of parts, accessories and consumables not authorised or recommended by Brightline. In such event, Brightline reserves the right to terminate the Limited Warranty immediately.
iii. Device with its serial number removed, defaced or altered.
iv. All decisions by Brightline in respect of the Limited Warranty (including repairs, replacements or issues relating to defects of workmanship or materials) shall be conclusive and binding on the Purchaser.
v. Nothing in these terms and conditions or otherwise arising from or in connection with the Limited Warranty shall be deemed or construed to be a policy of insurance between Brightline and the customer.
Data Roaming Service
2. Fair Usage of Data Roaming
The Device includes data roaming for use within the specified destinations’ network coverage. To ensure equitable access for all users and to prevent excessive network strain, the data roaming service is subject to a Fair Usage Policy (“FUP”).
3. Roaming Data Limits
Users of the Device may use data roaming within reasonable limits, as defined by Brightline. Should a user exceed these predefined limits, Brightline reserves the right to temporarily throttle, restrict, or suspend the roaming service. Data roaming limits may vary by country or region, and Brightline will provide such information to users before they incur roaming charges.
4. Excessive Use and Restrictions
If Brightline determines that a user is engaging in excessive or unreasonable data usage while roaming (including, but not limited to, streaming high-bandwidth content or large-scale data transfers), Brightline reserves the right to implement additional charges, reduce data speeds, or temporarily suspend roaming access. Brightline’s decision regarding what constitutes excessive usage shall be final.
5. Changes to Fair Usage Policy
Brightline reserves the right to modify or update this Fair Usage Policy at any time. Any changes to the FUP will be communicated to users through the contact details provided by the user or through an official notice on Brightline’s website.
6. Pay-Per-Use Pricing
Brightline offers a Pay-Per-Use pricing model for the Device Data Roaming service. Users will incur charges on a daily basis for the use of the Device, calculated from the day the service is activated until the day the service is deactivated.
7. Daily Usage Fee
The user will be charged a fixed daily fee for the use of the Device during the roaming period. The daily fee will be determined by Brightline and is subject to change. The applicable rate will be displayed on Brightline’s website or communicated to the user prior to activation.
8. Activation and Deactivation of Service
a. The daily usage fee will commence once the service is activated, which occurs when the Device is activated and connects to the network.
b. The service will be deemed to have ended when the Device is deactivated. The user will only be charged for the days on which the Device is in use.
9. Calculation of Data Roaming Charges
a. Charges will be calculated on a per-calendar-day basis, with each day representing a 24-hour period from midnight-to-midnight local time in the country where the Device was activated.
b. For example, if the Device is activated at 10:00 AM in Country X, the user will be charged for the entire calendar day (from midnight to midnight) in Country X.
c. If the user continues using the Device into the next calendar day (midnight to midnight) in the same country, the user will be charged for a new calendar day.
10. Payment
a. Payment for the purchased Device will be due in accordance with the terms specified in the invoice issued. The buyer agrees to pay the full amount stated in the invoice within the specified payment period.
b. Payment for the daily usage fee and any additional charges will be invoiced at the end of the billing cycle. The user agrees to pay any amounts owed for the use of the Data Roaming service, including applicable taxes and fees, using the payment method provided to Brightline.
c. Failure to make payment within the stipulated time may result in late fees or suspension as outlined in the invoice.
11. Refunds and Adjustments
No refunds will be provided for any unused portions of the day, as charges will apply per day, regardless of actual usage. Any disputes regarding charges should be raised within 30 days of the invoice date.
12. Modification of Pricing
Brightline reserves the right to modify the daily usage fee, or any additional charges associated with the service at any time. Users will be notified in advance of any such changes via email or Brightline’s website.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore
